Section 426 of the Austrian Commercial Code lists consignment-note details including the carrier, consignee, delivery place, goods, supporting papers, freight and special agreements. Section 427 requires the sender to provide supporting papers needed for customs, tax or police requirements. The sender is liable to the carrier for consequences of missing, insufficient or incorrect papers unless the carrier is at fault.
These rules may matter when the cause of a toll demand lies in information supplied by the shipper or sender. Examples include incorrect vehicle or cargo information, an unclear instruction or a missing document. The specific significance depends on the reason for the toll demand and the contractual sequence. Section 427 is not a blanket shipper liability for every demand.
Compare the order, confirmation, consignment note, vehicle and trailer data, axle information, tariff or emissions records, instructions and toll correspondence. For every item, record who created, checked, adopted or changed it. That makes breach of duty and causation reviewable.
